2. No-Logs Policy

No records pertaining to user activity, traffic content, connection metadata, or any other data passing through this node are created, stored, or retained. By technical design, the architecture of this node makes it impossible to capture, reconstruct, or derive any meaningful information from the transmitted data, ensuring that no personally identifiable or traceable information can be collected under any circumstances.

While this node does not log or store identifiable user data, the operator will:

- Respond to legally binding requests from law enforcement or regulatory authorities, as required by applicable law.

- Provide available information to address abuse complaints or legal obligations.

This cooperation is limited to information that can be provided without violating the node's no-logs policy or compromising privacy-preserving design.

Unauthorized use, uploading, downloading, or distribution of copyrighted, trademarked, or otherwise protected content.

Supporting or participating in actions that are contemptuous of human dignity.

Publishing offensive, racist, discriminatory, or pornographic content toward other users or the public.

Any other activity that violates national or international laws, regulations, or rights of third parties.

Users are responsible for ensuring that their activities comply with all applicable laws. Violations of these terms may result in immediate suspension or termination of access to the service.

5. Distinction from NymVPN Services

The operation of this node is governed exclusively by the Terms of Service of the node operator as set out herein. By using this node, the user implicitly enters into a binding agreement with the node operator under German law, thereby accepting these terms. This is independent of the NymVPN application or any services provided by Nym Technologies S.A.

The NymVPN application, along with all client-facing services including, but not limited to, software development, maintenance, technical support, subscription management, and the storage or handling of client data is provided solely by Nym Technologies S.A. and is subject to their separate Terms of Use, which can be found at https://nym.com/vpn-terms. Use of the NymVPN application, or selection of any global node via the app, does not replace, supersede, or affect the Terms of Service of this node.

The node operator is solely responsible for the operation and management of this node, including compliance with the node's Terms of Service and handling of abuse reports. Nym Technologies S.A. is solely responsible for the app, client-facing services, and associated user agreements. This separation clarifies operational responsibility and delineates legal accountability: the node operator does not automatically assume legal liability for the content of traffic passing through the node, except to the extent required by applicable law.

6. Liability and Disclaimer

The node operator provides this service on an "as-is" basis and does not assume any liability for any direct, indirect, incidental, or consequential damages resulting from the use, misuse, or inability to use this node. The operator does not guarantee uninterrupted or error-free operation and is not responsible for the content transmitted through the node by users.

By using this node, users acknowledge and accept that the operator cannot monitor, control, or be held liable for the nature, legality, or security of any data passing through the network. Users are solely responsible for their activities and compliance with applicable laws.

Abuse

That being said, if you still have a complaint about the router, you may email the maintainer. If complaints are related to a particular service that is being abused, the maintainer will submit that to the NYM Operators Community in order to add it to the Exit Policy cited above. The community governance can only blacklist entire IP:port destinations across the entire network.
